June 2025, Clay County, KY: Virgil Collins v. Manchester Shopping Center, LLC, et al.
Melissa Richardson and Summer Burgess obtained a dismissal for their clients, Manchester Shopping Center, LLC and Manchester Rentals, LLC (“Clients”), in a personal injury suit that arose after the Plaintiff slipped and fell at a closed car wash in the midst of extreme winter weather. The Clay Circuit Court reasoned that the Plaintiff’s presence at the car wash was not foreseeable as no reasonable person would have anticipated the Plaintiff would arrive at a closed business in inclement weather so severe as to cause a state of emergency to be issued. Therefore, the Court concluded that the Plaintiff could not produce any evidence establishing liability on the part of the Clients. Plaintiff’s efforts for the Court to alter, amend, or vacate its decision are pending.
